Following the running of Race 1, Lion Beverages Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Horseman, Mr D R Forbes, alleging a breach of Rule 869 (2) (a) in that Mr Forbes “used his whip excessively on OL MAN RIVER in the run home”.

DECISION AND REASONS:

Following the running of Race 1, Lion Beverages Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Horseman, Mr D R Forbes, alleging a breach of Rule 869 (2) (a) in that Mr Forbes “used his whip excessively on OL MAN RIVER in the run home”.

Mr Forbes was present at the hearing of the information and he indicated that he admitted the breach. The breach was found proved accordingly.

Rule 869 provides as follows:

--

(2)   No horseman shall during any race:-
      (a)  use his whip in an unnecessary, excessive or improper manner.

--

Mrs Williams showed a video replay of the final 300 metres of the Race. She pointed out Mr Forbes on OL MAN RIVER and alleged that he used his whip on approximately 20 occasions in the home straight. This was not disputed by Mr Forbes.

Mr Forbes asked the Committee to consider a suspension rather than a fine in this case. He stated that he had only the one horse racing at the present time.

--

Mrs Williams informed the Committee that Mr Forbes had a clear record over the past 12 months. She recommended a fine of $200 or a suspension of 2-3 days.

--

The Committee, in determining penalty, took into account Mr Forbes’ admission of the breach and his good record.

--

Mr Forbes’ horseman’s licence was suspended from the conclusion of racing today up to and including 26 December 2009 – effectively, 2 days.
