Decision: Following the running of Race 7 an information was laid by the Stipendiary Stewards under Rule 869 (2) (a) alleging that Mr Johnstone used his whip excessively over the final stages of the race whilst driving HERE COMES HOMER.
DECISION & REASON
--Following the running of Race 7 an information was laid by the Stipendiary Stewards under Rule 869 (2) (a) alleging that Mr Johnstone used his whip excessively over the final stages of the race whilst driving HERE COMES HOMER. At the commencement of the hearing the Chairman of the Committee asked Mr Johnstone to confirm that he denied the breach of the rule. Mr Johnstone asked if he could view the video of the last 300 metres of the race before answering that question. The video of that stage of the race was played and on the completion Mr Johnstone asked that his plea be changed admitting the breach of the rule. The information was amended and initialled by Mr Johnstone and accordingly the charge is found proven.

Mr Ydgren showed the video evidence of the incident again and Mr Escott asked the Committee to note the manner and number of times that Mr Johnstone hit HERE COMES HOMER or the cart of the horse. He said to the Committee that he thought it was about 24 hits and that he stopped using the whip short of the line.

Mr Johnstone said that he accepted the evidence of Mr Escott and indicated that he was trying to keep HERE COMES HOMER going as he felt tired and he did respond to the whip.

In respect of penalty Mr Escott said that there were no similar charges against Mr Johnstone under this rule in the last 12 months and that credit should be given for that and his guilty plea and recommended a fine only at the normal level.

Mr Johnstone, for his part, accepted the submissions of Mr Escott.

The Committee, after giving consideration to the evidence and the submissions, agrees that a monetary fine only is appropriate and after giving Mr Johnstone credit for his good record and guilty plea imposes a fine of $200.00.
