Decision:

The Committee carefully considered all evidence and submissions in conjunction with relevant video replays of the incident. It was clear that “Harlidon” was in the correct position, directly behind “Eye To Eye” in the lead up and when “Eye To Eye” broke approximately 70m from the start point “Harlidon” was forced to ease, take evasive action and in doing so lost 2-3 lengths.

We were satisfied that due to the breaking of “Eye To Eye” in the lead up “Harlidon” was denied a fair start with its chances materially prejudiced.

Facts:

Following the running of Race 1, the Monarchy Mobile Trot, an Information for a Request for a Ruling was filed by Stipendiary Steward, Mr S P Renault, to determine whether ”Harlidon” was denied a fair start.

The Information read as follows:

I, the above named informant seek a ruling in relation to Rule 213(1)(j) from the Judicial Committee to determine whether “Harlidon” was denied a fair start due to the breaking of “Eye To Eye” prior to dispatch.

Rule 213(1)(j) reads as follows:

“(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-

(j) if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.”

Submissions for Decision:

Mr Renault gave evidence and showed video replays of the lead up to the start where it was observed that “Eye To Eye” who had drawn ‘2’ at the mobile start, broke approximately 70m from the start point, lost ground and in doing so went back onto “Harlidon”, drawn 11 at the barrier, directly behind “Eye To Eye” .”Harlidon”(N R McGrath) had to ease and take evasive action to avoid “Eye To Eye” and in doing so lost 2 to 3 lengths.

Mr McGrath submitted that “Eye To Eye”, had broken in the run up and had caused him to ease and take evasive action to avoid that horse. He also submitted that “Harlidon”, who finished in 6th place, would have finished in a higher placing had the horse received a fair start. He believed that “Harlidon” was denied a fair start.

Reasons for Decision:

The Committee were satisfied that “Harlidon” was denied a fair start which materially prejudiced the chances of that horse. The Committee therefore ordered that “Harlidon” be declared a non-runner.
