It was ruled that “Latelastnight” be declared a late scratching in this race.
Facts:
Following the running of Race 7, the Morrison’s Saddlery Mobile Pace, an Information requesting a ruling was filed by Stipendiary Steward Mr S. P. Renault. The Request for a Ruling was made pursuant to Rule 213(1)(j) as to whether “Latelastnight” (17) had been denied a fair start.
The Information reads as follows.
“I the abovenamed informant hereby apply to the judicial committee and seek a ruling on the following matters:
Rule 213(1(j) – To determine whether Latelastnight should be declared a late scratching as a result of being denied a fair start when the hopple loop broke behind the mobile.”
Rule 213(1)(j) reads as follows.
“(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-
(j) if a horse is denied a fair start and such occurrence materially prejudiced the chances of that horse.”
Submissions for Decision:
Mr Renault gave evidence and used video coverage to show that prior to the start “Latelastnight” had galloped, and was still in a gallop when the race started. The video coverage clearly showed that the hopple loop broke before the start of the race, and this resulted in ”Latelastnight” taking no part in the race.
Mr Lock, the driver of “Latelastnight” said that he did not realise at the time that the hopple loop had broken when his horse galloped, and he agreed that this had resulted in his horse losing its chance in the race.
Mr Renault also advised that at the time the race started the starter also did not realise that the hopple loop had broken.
Mr Renault submitted that as “Latelastnight” had lost its chance before the start of the race it should be declared a late scratching.
Reasons for Decision:
We were satisfied that “Latelastnight” had lost its chance before the start of this race and should be declared a late scratching.
