Decision: Following the running of race 10 the Stipendiary Stewards lodged an information against N P Williamson, (HERE COMES SOKY), alleging that at approximately 400 metres to run Mr Williamson dropped his leg out of the sulky rest for approximately 200 metres.

At the outset of the hearing it was noted from a perusal of the information that the breach was admitted by Mr Williamson in writing and he did not wish to attend.

The Stipendiary Stewards showed the video evidence of the race at the relevant point and it was noted that Mr Williamson’s right leg was dropped and remained dropped out of the sulky footrest for approximately 200 metres. The charge is accordingly found proven.

The Committee were advised by the Stipendiary Stewards that Mr Williamson had not been charged under this rule in the previous months. The Stipendiary Stewards recommended a fine only.

The Committee after giving consideration to the incident, the early guilty plea of Mr Williamson and his previous record agrees that a fine only is appropriate and, accordingly, a fine of $100 is imposed.
