Charge:
Mr Parish misconducted himself by acting and speaking in a manner which was inappropriate to Security staff that was at the gate/control area on his arrival at the races.
Facts:
Stipendiary Steward Mr Coles said Mr Parish drove onto the course by the stable area intending to park in the centre of the course. He was stopped by security staff and asked for a pass. He referred the security staff to his personalized number plate which indicates he is a Jockey. Mr Parish then spoke abruptly to the security staff, drove off in a hurry spraying stones over the security staff and other cars and then parked in the centre of the course.
The security staff lodged a complaint with the race day Secretaries.
Mr Coles said Mr Parish had already apologised to the race days Secretaries.
Mr Parish accepted the summary of the incident given by Mr Coles. He said he had been unable to find his pass when asked for it. He said “I made a big mistake, I’ll never do it again, I’m very sorry for all of my actions”. He undertook to apologise to the security staff.
Submissions for Penalty:
Mr Coles said Mr Parish had been “upfront” about the matter and had no similar breaches on his record. He submitted that a fine in the range $300 - $500 was appropriate.
Mr Parish asked for the least possible fine.
Reasons for Penalty:
In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr Coles and Mr Parish, the apologies given and to be given by Mr Parish, the fact that Mr Parish has not offended in this manner in the past and views the offending as mid range. We also take into account another somewhat similar case of misconduct, less serious than this case, where a fine of $250 was imposed.
