Following Race 1 an information was filed pursuant to Rule 871(1)(d). The informant, Stipendiary Steward Mr Coles alleged that passing the 1800 metres Mr J Waddell riding SHI KIN FLY, allowed his mount to shift in causing GRAND AFFAIR, ridden by S Spratt to be tightened and checked.

Following Race 1 an information was filed pursuant to Rule 871(1)(d). The informant, Stipendiary Steward Mr Coles alleged that passing the 1800 metres Mr J Waddell riding SHI KIN FLY, allowed his mount to shift in causing GRAND AFFAIR, ridden by S Spratt to be tightened and checked.

Mr Waddell admitted the charge.

Stipendiary Steward Mr Williamson demonstrated the video films which clearly showed Mr Waddell riding SHI KIN FLY allow his mount to move in soon after the start and tighten GRAND AFFAIR on his inside who had to be checked. Mr Williamson said GRAND AFFAIR did miss the start and was moving up sharply which Mr Waddell was probably unaware of.

Mr Waddell explained this was the reason for him moving in and admitted he was unaware that Miss Spratt was there and it was an error of judgement on his part.

PENALTY SUBMISSIONS:

Mr Coles produced Mr Waddell's record which showed 2 charges in November under this rule. However, he submitted it was at the lower end of carelessness which warranted a 4 day suspension.

Mr Waddell said he did not have any firm commitments after today and he was going to ride in the South Island.

PENALTY:

The Committee considered all submissions and before imposing a penalty took into account the following:

  1. Mr Waddell's record. --
  2. His guilty plea. --
  3. His level of carelessness which we believe is at the lower end.
--

Accordingly, we impose a suspension to start after racing today, 4th January 2009 and conclude after racing on the 8th January 2009. (4 days)
