As Mr Jones admitted the breach the charge was found proved.

Accordingly, Mr Jones’ licence to ride is suspended for 5 riding days from the 17 January 2021 to the close of racing on the 28 January 2021. In addition to this suspension, he is fined the sum of $300.
Facts:
Following the running of Race 9 an Information was filed by Stipendiary Steward, Mr A Coles, against Apprentice Jockey, Mr C Jones in that he “permitted his mount JELLY TIP to shift inwards when not clear of VICKEZZNREHAB which was hampered and shifted out hampering LEGAL LADY and TRAVELLING KATE near the 900 metres.”
Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Jones had indicated on the Information that the breach of the Rule was admitted and he confirmed this at the hearing. Mr Jones stated he understood the charge and the Rule it was brought under.
Mr S Wenn, Licenced Trainer assisted Mr Jones at the hearing.
Mr Coles with the assistance of Mr Williamson used video coverage to show Mr Jones (JELLY TIP) who was racing 3-wide following the lead horse, shift into the racing line of VICKEZZNREHAB (D Johnson) when he had only a bare length advantage over that horse. Mr Williamson pointed to Ms Johnson take hold of her mount to avoid Mr Jones. He said Ms Johnson’s mount reacted awkwardly and shifted outwards resulting in LEGAL LADY (S Collett) and TRAVELLING KATE (C Grylls) being hampered. Mr Williamson said the inward shift by Mr Jones was low level but the consequences were mid-range. He said three horses have been checked to various degrees and Mr Jones had failed in his obligations to allow enough room.
Mr Jones had nothing to add to Mr Williamson’s assessment.
Mr Wenn said all three horses that were affected were racing ungenerously which exaggerated the incident and felt it was just a slight mistake made by Mr Jones.
Submissions for Penalty:
Mr Coles stated Mr Jones has now had four breaches under the Rule since July last year and related each of them to the Committee. He said the Stewards assessed this breach as low-range with mid-range consequences.
He asked the Committee to take into consideration that Mr Jones is a young rider who is learning but perhaps just trying too hard.
Mr Jones and Mr Wenn made no submission on penalty.
Reasons for Penalty:
The Committee assessed this breach as low to mid-range and adopted the NZTR revised Penalty Guidelines, which came into force in December and superseded all previous Guidelines in relation to these breaches, in finding an appropriate penalty.
Mr Jones’ record now could be best described as poor and is an aggravating factor.
In mitigation Mr Jones has admitted the breach. He has made a slight misjudgement which has compounded because the three affected horses were racing somewhat unkindly in what was very wet conditions.
With regard to the above factors the Committee considered a 5-day suspension and a $300 fine as an appropriate penalty in this case.
Mr Jones has an impending suspension for a Whip Rule breach incurred on 1 January which ends on 16 January 2021. Today’s suspension will start immediately after this date.
