Balancing the above matters but with emphasis on the good riding record of Ms Vance since her last suspension, Ms Vance’s riders licence is suspended for 6 days, commencing end of racing on 5th January 2011 and concluding end of racing on 16th January 2011.

Ms Vance shifted in SAN LEONARDO from the 800 metres dictating PIPPA (H Kasim) onto HEATHERMERIWEATHER (L Innes) who was checked, then further dictated RODGERTHECABINBOY (M Coleman) in onto FINANCIAL TERRORIST (L Satherley) who shifted in and checked OUR TYPHOON (S Spratt) and MANTOVA (M Hills).
Facts:
Stipendiary Steward Mr M Williamson showed and interpreted the video films of the incident. He said shortly after the start when insufficiently clear, Ms Vance moved SAN LEONARDO inwards initially tightening PIPPA and HEATHERMERIWEATHER and then tightening RODGERTHECABINBOY, FINANCIAL TERRORIST, OUR TYPHOON and MANTOVA. In particular HEATHERMERIWEATHER and FINANCIAL TERRORIST had to be sharply restrained. Ms Vance agreed with the interpretation of Mr Williamson and acknowledged she had allowed SAN LEONARDO to move inwards.

Mr Coles said Ms Vance had been suspended for 4 days for careless riding on the 3rd April and 29th May 2010. He said the interference to HEATHERMERIWEATHER and FINANCIAL TERRORIST was significant and the offending was medium to high. He submitted that a suspension in the range 5 – 8 days was appropriate. He said Ms Vance was a North Island rider. Ms Vance accepted she should be suspended. She said she had a riding engagement at the Whangarei Racing Club meeting on 5th January 2011.

In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr. Coles and the acceptance of them by Ms Vance, the starting point of 5 days suspension for careless riding and accepts the offending is above mid range. We also take into account that Ms Vance has not been suspended in the last 7 months.
