 As Miss Joyce admitted the breach we found the charge proved.

Penalty:

Miss Joyce is suspended from riding in races for 4 days from the close of racing on Thursday 28 November up to and including racing on Wednesday 4 December 2013.

Facts:

Following the running of Race 1, SRE ELECTRICAL 1000, an Information was lodged by Mr Williamson alleging a breach of Rule 638(1)(d) in that Miss Joyce, riding DAN THE MAN allowed her mount to shift out in the final straight causing a check to BECKINSALE ridden by Mr C Dell passing the 75m mark.

Submissions for Decision:

Mr Williamson read the rule and Miss Joyce acknowledged that she understood the nature of the charge and that she admitted the breach.

Miss Joyce is an apprentice rider and had licensed trainer Mr S McKee, to whom she is apprenticed, to assist her.

Stipendiary Steward, Mr J Oatham demonstrated the incident on the avilalable video films, which included the head on, side on, and rear view films. He identified Miss Joyce riding DAN THE MAN and Mr Dell riding BECKINSALE. Approaching the 100m mark he pointed out that Miss Joyce was using her whip on her mount which began to drift outwards. DAN THE MAN shifted out at least 3 horse widths into the path of BECKINSALE, causing Mr Dell to check his mount at about the 75m mark. DAN THE MAN was barely one length ahead of BECKINSALE at that time, and Mr Oatham added that while BECKINSALE was making 'some'ground at the time, it was not the worst interference he had seen. DAN THE MAN eventually finished 4th while BECKINSALE was unplaced.

Miss Joyce had nothing to say at this time.

Mr McKee commented that it was helpful to see the incident from the various angles and that he and Miss Joyce would use the incident as a 'learning curve'. He added that in his opinion the other horse (BECKINSALE) was not 'doing much'and that he and Miss Joyce would put this matter down to experience.

Submissions for Penalty:

Mr Williamson told the Committee that Miss Joyce had an 'excellent' record in that she had incurred no breaches of this Rule within the last 12 months. He added that the Stewards viewed this incident as being at a low level and would submit that a penalty could reflect that.

In response from questions from the Committee Mr Williamson confirmed that Miss Joyce had in fact commenced her race-riding career on 7 November 2012 and up until today had ridden in 38 races.

Miss Joyce advised the Committee that she had no upcoming riding engagements and was able to commence any period of suspension immediately. She added that she appreciated being able to view the incident on the video films as the different angles shown would help her to deal with the incident and use it as part of her learning experience. As riding engagements were already confirmed for racing at TeAwamutu the following day the Committee advised Miss Joyce that her suspension would have to start after that day's racing. The Stewards agreed that Miss Joyce could be deemed a 'North Island' rider when taking into account the term of her suspension.

Reasons for Penalty:

The Committee took into account all of the submissions, and adopted as a starting point, a period of five days suspension as per the JCA penalty guidelines in respect of breaches of this Rule.  We assessed the level of carelessness and the consequences to be at the lower end of the scale. The rear view film was particuarly helpful and showed Miss Joyce drifting out into Mr Dell's line of running while applying the whip to her mount.  The Committee explained to Miss Joyce that she had an obligation to take corrective action immediately in these circumstances, including not using her whip while she straightened her mount. We give Miss Joyce credit for her admission of the breach, and her excellent record, and are satisfied that at this stage of her riding career, Miss Joyce is only able to ride across the North Island. Taking into account all of these factors we imposed a 4 day period of suspension.
