Following race 1 a protest was lodged by Stipendary Steward Mr J Oatham pursuant to Rule 876(1) when it was alleged that DOUBLE BARREL or its rider placed 1st by the Judge interfered with the chances of FOREVER ROSES
Following race 1 a protest was lodged by Stipendary Steward Mr J Oatham pursuant to Rule 876(1) when it was alleged that DOUBLE BARREL or its rider placed 1st by the Judge interfered with the chances of FOREVER ROSES placed 3rd by the Judge.
--Mr Oatham reserved the right to charge Mr Du Plesis.
--The interference occurred in the final straight.
--The Judges margin between 1st and 2nd was 1 length and a long head between 2nd and 3rd.
--Present were Mr G Tankard and M Du Plesis representing DOUBLE BARREL.
--Mr G Newham and Ms L Cropp represented FOREVER ROSES.
--Mr Williamson demonstrated the head, side, and rear view videos. He showed where, at the 200metre mark, DOUBLE BARREL (M Du Plesis) was racing approximately 6 horses wide with FOREVER ROSES on its inside 4 horse widths from the rail. As the field progressed down the straight DOUBLE BARRELL moved inwards to be 2 horses off the rail. In doing so he took the line of FOREVER ROSES when there was insufficient clearance. Ms Cropp could be seen to check her mount and then switch across and come for an outside run. Mr Williamson suggested that FOREVER ROSES lost at least 1 length in the incident.
--Ms Cropp, the rider of FOREVER ROSES said that on the turn she had plenty of room to move. DOUBLE BARREL had just run in and taken her line. She felt that she should have won the race.
--Mr Tankard, representing DOUBLE BARREL, said that his horse was always going to win the race.
--Mr Du Plesis, the rider of DOUBLE BARREL, said that his mount was running greenly and he was trying to keep it straight as it tried to duck in.
--Mr Oatham said that Ms Cropp could clearly be seen to check her mount as her line was crossed.
--DECISION:
--The committee is in no doubt that FOREVER ROSES did suffer interference when its line was taken by DOUBLE BARREL.
--Having found that interference has taken place we must decide whether, in our opinion, this interference has affected the chances of FOREVER ROSES finishing in a better place, taking into account the margin of a long head between 2nd & 3rd.
--After taking into account the amount of ground lost by FOREVER ROSES, the margin of a long head, and also the way that she was finishing after she was re-balanced we are in no doubt that FOREVER ROSES chances of finishing in a better place were affected.
--The protest is upheld and the placings are now
--1st 7 DIAMOND ‘R US
--2nd 9 FOREVER ROSES
--3rd 4 DOUBLE ROSES
--4th 2 MEDIUM PROVIDES
