Following race 7 a protest was lodged by Stipendary Steward Mr J Oatham pursuant to Rule 876(1) when it was alleged that KEEPABIT or its rider placed 2nd by the Judge interfered with the chances of ROULEAU placed 3rd by the Judge and YETANOTHERHOARSE



Following race 7 a protest was lodged by Stipendary Steward Mr J Oatham pursuant to Rule 876(1) when it was alleged that KEEPABIT or its rider placed 2nd by the Judge interfered with the chances of ROULEAU placed 3rd by the Judge and YETANOTHERHOARSE who was placed 4th by the judge.

The interference occurred in the final straight.

--

The Judges margin between 2nd & 3rd was 1 length and the margin between 3rd & 4th was ½ a length.

--

Present were Mr S McKee and G McKeon representing KEEPABIT.

--

Mr D Lang and S Saad represented ROULEAU.

--

Mr C Gibbs and Ms T Thornton represented YETANUTHAHOARSE.

Mr Williamson demonstrated the head, side, and rear view videos. As the horse approached the 100 meter mark KEEPABIT, who was leading and on the rails suddenly ran out sharply and hit YETANUTHAHOARSE with force. YETANUTHAHOARSE managed to keep its feet but was catapulted into ROULEAU who was severely buffeted.

Ms Thornton, rider of YETANUTHAHOARSE said that the video clearly showed the severe interference that had occurred.

Mr S Saad, rider of ROULEAU, said he felt that he lost at least 2 lengths.

--

Mr McKee, trainer of KEEPABIT, raised his hands in submission and said it was very plain to see what had happened.

DECISION:

--

There being unanimous agreement that interference had taken place the committee had to decide whether, in our opinion, this interference had affected the chances of ROULEAU and/or YETANUTHAHOARSE finishing in better places, given the margin between 2nd & 3rd of 1 length and between 3rd & 4th of ½ a length. Taking into account the severity of the interference we are in no doubt that both horses chances were severely affected.

In upholding the protest the committee appreciate Mr McKee’s approach to the incident.
