Decision:

Following race 1 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham, that Mr M Du Plesis, rider of DOUBLE BARREL permitted his mount to shift inwards near the 100 metres when not sufficiently clear



Following race 1 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham, that Mr M Du Plesis, rider of DOUBLE BARREL permitted his mount to shift inwards near the 100 metres when not sufficiently clear of FOREVER ROSES (L Cropp) who was checked.

Mr Du Plesis did not admit the charge.

Mr Williamson demonstrated the videos that showed soon after entering the straight Mr Du Plesis’ mount DOUBLE BARREL, which was racing about 6 horse widths wide, start an inward movement. Inside Mr Du Plesis, but with plenty of room between them was Ms Cropp riding FOREVER ROSES. Mr Du Plesis could not be seen to take any visible action to straighten his mount as he continued to ride him out, checking FOREVER ROSES as he crossed her line when not sufficiently clear.

Ms Cropp, when questioned, said that Mr Du Plesis was only a neck in front of her when the movement began. Mr Du Plesis challenged her on this margin and the side on video confirmed the distance to be at least ¾ length. It was clear that this distance was far too close to allow a trouble free movement.

Mr Du Plesis said he was trying to do his best for his owners and the horse was running very greenly and he claimed he was trying to straighten the horse using his left rein.

Mr Oatham, in summary, said that in his view Mr Du Plesis at no time stopped riding his mount and at no time could the horses head turn in an attempt to straighten it.

The committee, after reviewing the evidence prefers Mr Oatham’s evidence and finds Mr Du Plesis guilty in that he made no visible effort to straighten his mount and continued to ride it with vigor as it took the line of FOREVER ROSES when not sufficiently clear.

Mr Oatham gave Mr Du Plesis exceptional record. Since he began riding in New Zealand in the year 2000 he had not had a charge of careless riding. During that time he had ridden overseas and Mr Du Plesis volunteered that during those 3 years in Singapore and Australia he had received 4 suspensions. Mr Oatham said he felt the offence was at the lower end of the scale and asked for a suspension of 4-5 days.

Mr Du Plesis said he was doing his best for his owners.

The committee, after taking into account Mr Du Plesis’ exceptional record, the degree of interference and the status of the races that he will be missing during his suspension, suspend Mr M Du Plesis from after the completion of racing on 21 January till after the completion of racing on 26 January 2008.
