Following the running of race 7 an information alleging a breach of rule 869 (3) (b), "careless driving" was filed. The informant was Mr J M Muirhead and the defendant Mr B Lee the driver of Caesars Art in race number 7.

Following the running of race 7 an information alleging a breach of rule 869 (3) (b), "careless driving" was filed. The informant was Mr J M Muirhead and the defendant Mr B Lee the driver of Caesars Art in race number 7. The information alleged that horseman Mr. B Lee drove Caesars Art carelessly striking the sulky wheel of Cast Adrift, (Mr. R Green) with 300 meters to run. Mr. Lee admitted the breach of this rule and indicated on the information he did not wish to be present at the hearing of this information. Mr. Muirhead showed the video of this incident and it was clearly visible that Mr. Lee had struck the wheel of Cast Adrift with approximately 300 meters to run. Mr. Muirhead also showed the back view of this incident which also confirmed that Mr. Lee's horse had struck the wheel of Cast Adrift.

Mr. Muirhead made submissions on penalty stating that he considered this breach to be at the lower end of the scale. Mr. Lee's driving record was produced for the Judicial Panel to peruse.

Having taken into account the admission of the breach of this rule by Mr. Lee and also the submissions on penalty from Mr. Muirhead this Judicial Committee imposed a fine of $200.00 in this instance.
