An Information was lodged by Stipendiary Steward Mr J Muirhead alleging that Driver Miss N Chilcott failed to immediately take all reasonable steps to return CAMERON JAKE to its proper gait and/or when a clearance existed to immediately take CAMERON JAKE clear of the field when the horse galloped for the first 140 metres or so of Race 5.
----Miss Chilcott denied the charge and was present for the hearing.
----Mr Muirhead read the contents of Rule 870 to the hearing and specifically alluded to the clauses of subsection 2 which relate to failure to take the horse clear of the field, failure to take all reasonable steps to return the horse to its proper gait, and failure to lose ground by the break as being breaches of sub rule (1).
----He then demonstrated by way of video footage, various views of the start of Race 5, in which CAMERON JAKE, drawn 4, galloped away off the mark moving forward and gaining ground. Miss Chilcott was trying to catch it back into a trot but has allowed the horse to gallop for about 140 metres, such a distance, which was in his opinion clearly unreasonable. She made no movement to take hold of the horse or move clear of the field.
----Mr Muirhead agreed with Miss Chilcott’s assertion that CAMERON JAKE had a propensity to gallop away and then commence trotting. Miss Chilcott referred to video footage which she said indicated that there was insufficient room for her to take CAMERON JAKE clear of the field.
----Mr Muirhead indicated that Miss Chilcott had not even looked around or taken hold of the horse which should have been done if she was looking to move clear of the field. He said there was clearly sufficient room for CAMERON JAKE to be taken clear. He reiterated that in establishing a breach of this rule that only one element of subsection 2 had to be established.
----Miss Chilcott reinforced the fact that CAMERON JACK was a difficult horse and that she had twice taken his head in an effort to drop him back into a trot. which was the only way to get him back to the correct gait.
----DECISION
----I am satisfied that there has been a breach of this Rule as it is clear from the video footage that Miss Chilcott failed to take CAMERON JAKE clear of the field or lose ground after it broke at the start of the race.
----The distance of approximately 140 metres it continued to gallop also supports Mr Muirhead’s contention that insufficient reasonable action was taken by Miss Chilcott to return the horse to its proper gait.
----PENALTY
----Mr Muirhead submitted that two days suspension was in order bearing in mind the normal penalty for a first offence was in the range of two to four days. This was not a good example of offending and was in the higher level. Miss Chilcott is a highly experienced horsewoman. He strongly objected to a fine for this breach.
--Miss Chilcott submitted that a two days suspension with the forthcoming Calendar was in effect 3 days because of the racing in Palmerston North on the 1st and 4th November interspersed by Auckland on the 2nd. Drivers who took the first day at Palmerston always drove the 2nd day. With a full book of drives on each day such a suspension would cost her approximately $1500.
----She asked for a fine in lieu of suspension.
----Taking into account these submissions, the offence committed and the driving record of Miss Chilcott a two day driving suspension is applied. This suspension concludes after racing on Friday 2nd November 2007.
