The protest was dismissed. The Judges' placings were confirmed and payment of dividends was authorised.

Facts:

An information lodging a protest was presented by Stipendiary Steward Mr J Muirhead at the instigation of Mr K Judson owner/driver of horse 5 Day in Calcutta.

It alleged that Day in Calcutta received interference from horse 1 Greg Brydon with approximately 350 metres to run.

Mr Judson appeared in support of the protest which was contested.

Mr R Frampton part owner/driver and Mr A Neal part owner/trainer of Greg Brydon were present to challenge the protest.

The provisional placings were:

1st 4 Claudia Cardinal
2nd 1 Greg Brydon
3rd 3 Dead Calm
4th 5 Day in Calcutta
5th 7 All About Speed
6th 8 Operative Word

Submissions for Decision:

Mr Muirhead referred to video footage of the concluding stages of the race and identified the runners of interest. Coming out of the back straight and into the final turn Mr Frampton was 4 back on the running line and Mr Judson was immediately behind him.

Mr Frampton came off the running line onto the back of Anvil Justice two wide. Mr Judson improved forward before Mr Frampton elected to drop back down onto the running rail. Mr Judson had to take hold to avoid contact with Greg Brydon.

The margin between 2nd and 5th was 1.1 lengths.

Mr Frampton told the hearing he had come off the fence looking to improve forward but then decided he was better off back on the fence. Mr Judson followed him out before moving back towards the running rail a fraction before he did. There was very little tightening during this manoeuvre and in his opinion it made no difference to the final placings.

Mr Judson told the hearing that when Mr Frampton moved out he improved forward before Mr Frampton ducked back down in front of him. If he hadn’t taken hold of his horse he would have had his horse’s front legs taken out. He denied that he had also improved outwards when Greg Brydon had moved. There was no contact made.

Mr Neal disputed that Mr Judson had remained on the rails. He submitted that the manoeuvre was common in racing when at this stage of the race horses were looking to improve everywhere. He realised it was an amateur race but Mr Judson was looking to improve as well and had initially moved out to follow Greg Brydon.

Reasons for Decision:

The observations from the various parties gave differing interpretations of the course of events. The video footage provided from all angles of the relevant stage of the race did not serve to support in any material way the protest lodged.
