Decision:

Following the running of race No 10, an information was filed alleging a breach of the rules.

The Informant was Mr J M Muirhead and the defendant  Mr. R Brosnan the driver of Pacific Idol

Following the running of race No 10, an information was filed alleging a breach of the rules.

The Informant was Mr J M Muirhead and the defendant  Mr. R Brosnan the driver of Pacific Idol.

--

The information stated that horseman Mr. R Brosnan came to the starting gate at position 6 on the second row instead of position 5 on the second row.

--

Mr. Muirhead showed the video of the run up and the start of this race and this clearly showed Pacific Idol to be at 6  on the second row.

--

Mr. Brosnan was questioned as to why he had taken this position and he stated that Mr. Cooney was in this position and he could not get to his rightful starting position. Mr. Brosnan also stated that he knew he should have been following Red Gem (Mr.B Lee). Mr. Muirhead also stated to the committee that he had spoken to the starter and he had not picked that both Mr. Brosnan and Mr. Cooney were in the wrong starting positions until it was too late to   signal a false start.

Decision And Reasons.

--

This  Judicial Committee finds that under the provisions of rule 857 (7) (d) which states ?No Horseman Shall? (d) come to the starting gate out of position.  We find that Mr. Brosnan is in breach of rule 857 (7) (d) as he was not in his correct barrier position at the start of this race.

Under the provisions of rule 857 (7) (d) the onus is on the horseman to have his horse in the correct barrier position at the start.

--

Mr. Muirhead made submission on penalty as did Mr. Brosnan and the driving record of Mr. Brosnan was presented for perusal.

--

A  fine of $150.00 was imposed in this instance.
