Following the running of race No 7, an information was filed alleging that Mr. S. Phelan was in breach of rule 869 (3) (b) ?Careless Driving?. The information stated that horseman Mr. S. Phelan drove Miss Bubbles carelessly when attempting to improve his horse outwards inside ?River Waltz?, (Mr. A. G. Herlihy) with 600 meters to run causing ?Miss Bubbles' to break losing its chance.
--Mr. Phelan admitted the breach of this rule and was present at the hearing.
--Mr. Muirhead showed the video of this incident and made submissions on penalty as did Mr. Phelan. Mr. Phelan's driving record was produced for perusal. Mr. Muirhead recommended a fine in this instance as he considered this offending to be at the lower end of the scale.
--Decision And Reasons.
--This Judicial Committee having taken into account the admission of the breach by Mr. Phelan also Mr. Phelan's good driving record imposed a fine of $250.00 in this instance.
