Decision:

Following the running of race No 10, an information was filed alleging a breach of the rules.

--

The Informant was Mr J M Muirhead and the defendant Mr. F D Cooney. The information alleged that Horseman F. Cooney came to the starting gate out of position at 5 on the second row instead of 6 on the second row with Western Alliance.



Following the running of race No 10, an information was filed alleging a breach of the rules.

The Informant was Mr J M Muirhead and the defendant Mr. F D Cooney. The information alleged that Horseman F. Cooney came to the starting gate out of position at 5 on the second row instead of 6 on the second row with Western Alliance.

Mr. Cooney did not admit the breach and was present at the hearing of this information.

--

Mr. Muirhead showed the video of the run up to the start and this showed Western Alliance coming up to the start out of position. Mr. Muirhead stated that the onus is on the horseman to make sure he is in the correct barrier position prior to the start. Mr Cooney in his evidence stated he could not get to his correct position because Mr. Brosnan was out at 6 where Mr Cooney should have been, Mr. Cooney also stated he could not drag Western Alliance back and out as he felt this filly would have broken.  Mr. Cooney also stated to the committee that his filly was pacing rough and hanging.

Decision And Reasons.

This  Judicial Committee finds that under the provisions of rule 857 (7) (d) which states ?No Horseman Shall? (d) come to the starting gate out of position Mr. Cooney is in breach of this rule.

This Judicial Committee also acknowledges that Mr. Cooney was having trouble with Western Alliance in regards to this filly hanging and pacing roughly in the run up to the start.

--

Mr. Muirhead made submissions on penalty and asked for a fine in this instance.

--

Mr. Cooney also made submissions on penalty and the driving record of Mr. Cooney was presented for perusal.

--

A  fine of $150.00 was imposed in this instance.
