An information lodged by Stipendiary Steward Mr J Muirhead against Mr D McGowan driver of CHEEKY CHARM alleging a breach of Rule 869 (2)(a) ? excessive use of the whip ? in that he used the whip excessively when driving out his horse over the concluding stages of the race. Mr McGowan admitted the breach and did not wish to be present at the hearing. Mr Muirhead demonstrated the incident by use of the video film. Mr McGowan used his whip about 28 times in the home straight but did not hit the horse on all occasions.
--PENALTY
--Mr Muirhead suggested a fine in the region $200.00 - $300.00. He said Mr McGowan was disappointed in himself and could not understand why he had used the whip so many times. He said Mr McGowan had a clear driving record. In fixing penalty I took into account the following matters :

- The guilty plea ? although this was somewhat inevitable. --
- Mr McGowan's clear driving record. --
- The submissions of Mr Muirhead. --
- The explanations of Mr McGowan. --
- The offending was mid-range on the scale of seriousness. --
- Penalties recently imposed for a breach of this rule.
Balancing all of those matters I imposed a fine of $250.00.
