--This is an information filed by Stipendiary Steward Mr J. Muirhead against Mr P. Scaife trainer of WAYWOOD ANGEL alleging a breach of the above rule in that he failed to correctly affix the hopple shortener cord so as for it not to malfunction.
--Mr Scaife admits the breach and is present at the hearing.
--Mr Muirhead showed and interpreted the video film of the incident. At about the 700m mark the hopple shortener cord became entangled with the front leg of CARLOS which was trailing WAYWOOD ANGEL. This caused severe interference to both horses.
--Mr Scaife acknowledged that the hopple shortener cord had fallen down the back of the sulky but he didn’t know why.
--Penalty:
--Mr Muirhead said Mr Scaife had no relevant breaches of the rules recorded against him and that the offending was mid range on the scale of seriousness. He emphasised that the chances of two horses were affected. He said the recommended starting point for penalty is a fine of $250.00 and that was his recommendation for penalty.
Mr Scaife accepted that recommendation.
In fixing penalty the committee takes into account the guilty plea, the submissions of Mr Muirhead, the acceptance of them by Mr Scaife, Mr Scaife’s clear record, the recommended starting point and accepts that the offending is mid range on the scale of seriousness. Balancing those matters but with emphasis on the fact that the chances of two horses were affected, a fine of $250.00 is imposed.
