As the breach was admitted we find the charge proved.

Penalty:

After taking all the above into account and under the provisions of rule 1106 (2) we suspend Miss Spratt from riding in races which is to start after racing on 14 April and conclude after racing on 23 April 2012 (6 days).

Facts:

Following race 2 an information was filed pursuant to rule 638 (1)(d).  Mr J Oatham alleged that Miss Spratt, rider of SATURN ROCK, caused interference to SO WOTIF near the 300 metres.

Submissions for Decision:

Mr Oatham demonstrated the video films which showed Miss Spratt forcing a run outwards and making heavy contact with SO WOTIF at the 300 metres.  He stated there was insufficient room for her to do so. 

Miss Spratt, in admitting the breach, said her mount seemed to overreact to her outward movement.

Submissions for Penalty:

Mr Oatham said this was Miss Spratt's 5th charge in the last 12 months.  He reminded the committee this was a $20,000 race on a premier day and a relegation resulted from the incident.  He submitted a suspension of 6 - 7 days would be appropriate. 

Miss Spratt said she had commitments up to and including 14 April and she was a North Island rider only.

Reasons for Penalty:

The committee carefully considered all evidence and submissions as presented.  The only mitigating factor is Miss Spratt's admission of the breach.  Clearly in this case she has moved out when insufficiently clear which resulted in a relegation.  The committee finds Miss Spratt's carelessness to be in the mid to high range.
