--Mr Oatham showed the video film of the incident. Mr Ormsby stood up and waved his whip one stride prior to the winning post. Mr Ormsby said he was “Over the moon” because he won the race.

--Mr Oatham said this was the first charge Mr Ormsby had faced – it is his first season with a full licence - he was over excited – the offending was at the lower end of the scale. He submitted that a fine of $150 was appropriate. Mr Ormsby accepted the submissions of Mr Oatham.
