The Committee has to be of the opinion that DUNEAGLE would have finished ahead of LES CRAYERES had the interference not occurred. It is not. The protest is dismissed.

Stakes and dividends are to be paid as called by the Judge.

Facts:

Following the running of Race 2 Ms S Collett, the Rider of the third placed horse DUNEAGLE protested against the first placed horse LES CRAYERES alleging interference in the final straight.

The Judge’s placings were:
1st - 5 LES CRAYERES
2nd - 11 COME BACK TIGER
3rd - 8 DUNEAGLE
4th - 3 MARRONI

The margins were a short neck and 3/4 L.

Submissions for Decision:

Ms Collett with reference to the videos said that near the 300 metres she was crowded for 5 or 6 strides and was denied a run. She said she was racing to the inside of Ms Johnson, who was racing in behind the leading horse COME BACK TIGER. Ms Johnson had taken a run to the inside of that horse and, in so doing she had crowded her. She believed that her mount DUNEAGLE was finishing better than LES CRAYERES.

Mr Pellett said that the interference had cost DUNEAGLE 2 lengths whereas the margin between LES CRAYERES and DUNEAGLE was close to a length.

Mr Kelso stated that he believed that DUNEAGLE would never have beaten LES CRAYERES. LES CRAYERES had in fact pulled up a bit once it got to the front. He agreed that DUNEAGLE was held up a little, but the margin was close to a length. He added that in his opinion the protest was frivolous.

Ms Johnson said the leading horse was drifting wider on the track and she believed there was a full gap for her to its inside. That was why she had taken the run. She also stated that LES CRAYERES had pulled up once it got to the lead. She said when regard was had to the margins, LES CRAYERES was always going to win. She reiterated she had been dictated by the leading horse.

Mr Williamson commented on the evidence. He said there had been interference. He believed that LES CRAYERES had crowded DUNEAGLE when Ms Johnson had shifted in off the heels of COME BACK TIGER. He said it was difficult to estimate the ground DUNEAGLE lost. The Stewards thought it was about 1/2 a length. While DUNEAGLE was making up some ground on LES CRAYERES at the finish, the Committee had to decide whether in terms of the Rule DUNEAGLE would have beaten LES CRAYERES.

Reasons for Decision:

The margins are a short neck and 3/4 L. The Committee is not satisfied that the interference by LES CRAYERES (the crowding of DUNEAGLE) was severe enough to warrant a change of placings. We agree with the Stewards that it is difficult to assess the ground DUNEAGLE lost. The horse was placed in restricted room by the inwards movement by LES CRAYERES and was steadied for some half a dozen strides. DUNEAGLE did finish the race off slightly better than LES CRAYERES, but that horse was also still giving at the line.
