Accordingly we declare MAJOR RIO a runner.
Facts:
Mr Oatham said MAJOR RIO had started from the outside gate and at the time the gates were released it was clear that MAJOR RIO had dropped its head to the ground which resulted in that runner losing several lengths. Mr Oatham confirmed that the gate had opened in unison with the others.
Mr J Humphries, the starter, said he did not hear the rider call and was unaware MAJOR RIO had its head down when he released the gates.
Miss Johnson said she did call but obviously was not heard.
Mr Hillis confirmed the horse had no previous issues with dropping its head at the start.
In summing up Mr Oatham said his concern was the delay between when the horse dropped its head and when the gates were released. He said the horses chances were severely affected and submitted that MAJOR RIO was denied a fair opportunity.
