Following race two an information was lodged against J Sargent, trainer of FUNRAAD (number 11), alleging a breach of Rule 858(4) and 857(3), namely in that he omitted a lead bag when saddling FUNRAAD
| -- DECISION & REASON: ----Following race two an information was lodged against J Sargent, trainer of FUNRAAD (number 11), alleging a breach of Rule 858(4) and 857(3), namely in that he omitted a lead bag when saddling FUNRAAD ridden by L Allpress who subsequently weighed in for sixth placing 3 kgs under the required weight. ----Mr J Sargent admitted the breach. ----The sole issue is penalty. After hearing submissions from Mr Oatham and hearing Mr J Sargent's explanation we consider a fine is appropriate. In fixing the fine we take into account that no stakes were payable for sixth placing and no dividends were affected, and Mr Sargent pleaded guilty. Accordingly, a fine of $300 is imposed. ----Pursuant to Rule 857(3) FUNRAAD is disqualified. |
