Facts:
Following the running of Race 1 (King Honey Taupo Gallop,) Information A12910 was filed with the Judicial Committee. It was alleged by the Informant that Mr Kozaki, the Rider of FLYING permitted his mount to shift in near the 1700m when insufficiently clear of ELLE D’BERRY which was crowded and checked.
Mr Kozaki said that he understood the Rule, Charge and confirmed that he admitted the breach of the Rule.
Mr Williamson showed the available films and said that Mr Kozaki let his mount shift in one to two horse-widths shortly after the start and crowded ELLE D’BERRY which was checked. He said that when FLYING commenced to shift in it was only one length clear. Mr Williamson said that ELLE D’ BERRY was a little slow to begin and had pushed up inside FLYING which may have contributed to the incident. He added that Mr Kozaki had looked in prior to shifting.
Mr Kozaki agreed with Mr Williamson’s interpretation and also said that ELLE D’BERRY had been slow to jump away and had improved through on his inside.
Submissions for Penalty:
Mr Kozaki’s record showed two recent suspensions for careless riding, those being on 14 December 2019 (8 days) and 9 November 2019 (7 days).
Mr Jones placed the carelessness just below mid-range and submitted that a suspension be imposed.
Mr Kozaki asked that any suspension start after racing on 3 January 2020.
Reasons for Penalty:
The Committee placed the carelessness in the mid-range category due to the fact that Mr Kozaki looked inwards before he shifted which would have indicated that he was aware of the horse to his inside, plus ELLE D’BERRY received a relatively severe check.
Taking into account the JCA starting point of a 8 riding-day suspension for mid-range carelessness, Mr Kozaki’s record and the admission of the breach, it was determined that a 7 riding-day suspension was an appropriate penalty.
