Mr Jones’ Jockey’s Licence was suspended from the end of racing on 3 January 2019 up to the close of racing on 10 January 2019.
Facts:
Following the running of race 6 (Harcourts Taupo Cup), Information No. A11256 was filed with the Judicial Committee. It was alleged by the Informant that Mr Jones permitted his mount SASANOF’S HERO to shift outwards near the 600m when not sufficiently clear causing interference to SANASAR and FLAG THE GROOM.
Rule 638(i)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless
Mr Jones said that he understood the Rule and confirmed that he admitted the breach.
Mr Oatham showed the film replays and said that Mr Jones who had been racing on the fence shifted his mount out onto SANASAR who in turn shifted out onto FLAG THE GROOM; as a consequence both of those runners were forced over extra ground. He estimated that Mr Jones and his mount were only half a length clear when shifting.
Mr Jones for his part said that he did come out one horse width and tighten SANASAR but that SANASAR was lugging out and exaggerated the movement.
Submissions for Penalty:
Mr Coles said that Mr Jones had a very good record with only one breach of the Rule in a long period of time. He placed the carelessness in the low-range and submitted that a suspension in accordance with that degree of carelessness be imposed.
Mr Jones said that his record is very good and asked for a deferment of a suspension until after racing on 3 January 2019.
Reasons for Penalty:
The Committee gave careful consideration to all submissions placed before it. It was clear that Mr Jones did shift out when not clear and caused minor interference to SANASAR and FLAG THE GROOM with 600m to travel.
In fixing quantum of penalty consideration was given to the admission of the breach, very good record, low-range carelessness and the JCA Penalty Guidelines, following which it was determined that a 5 riding-day suspension was a suitable penalty.
