Facts:
Following the running of Race 3 (Starlight Cinema Centre 1200), Information No. A8853 was filed with the Judicial Committee. Mr Coles alleged that Ms Thornton allowed her mount STAND FIRM to shift in when not sufficiently clear of I’M MURPHY which was crowded and checked near the 800m, losing ground.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless.
Ms Thornton indicated that she understood the Rule, charge and confirmed that she admitted the breach.
Mr Jones showed the film replays and said that near the 800m Ms Thornton allowed her mount to shift in and crowd and then check I’M MURPHY. He said that Ms Thornton’s mount was only a half-length clear when it shifted in.
Ms Thornton in response said that her horse was a first starter, a little green and that the inside runner contributed to the incident.

Mr Coles said that Ms Thornton had a very good record during the past 12 months with only one breach being recorded, with that being on 1 February 2016. He said that CUT THE CHASE who was racing inside I’M MURPHY, shifted out a little and contributed to the incident. He said that the Stewards placed the carelessness in the mid-range category. Mr Coles presented evidence that Ms Thornton has ridden in the Central Districts in recent times.
In answer to a question from the committee, Ms Thornton said that she would prefer any suspension imposed to commence after racing on 3 January 2017.

The committee placed the carelessness in the mid-range and using the JCA starting point of 5 riding days suspension for careless riding, believed that a discount of 1 day was appropriate due to the very good record and admittance of the breach.
