Miss K Hercock admitted a breach of Rule 871 (1) (d) in that she allowed her mount WHO SLAPPED JOHNNY to shift in near the 850 metre mark when not clear and causing a check to RAPID RIELLE (M Walker)

Both available films of the incident were shown and Stipendiary Steward J P Oatham pointed out the inward movement of Miss Hercock’s mount and the action taken by jockey M Walker as a result of that movement.

Miss Hercock informed the committee that although she admitted the charge and the movement inwards did inconvenience Mr Walker she felt that he did not help the situation..

Miss Hercock’s record under this rule indicated she was last charged on 13 October 2007. Mr J P Oatham told the committee although her record under this rule was good considering the amount of riding Miss Hercock undertakes, he believed the incident was one on the higher end of the scale, and felt a period of suspension was warranted. He informed the committee that a period of between 4 and 6 days would be appropriate.

Miss Hercock told the committee that she had a busy period of riding coming up right through until next Sunday and that she does ride at a number of venues.

DECISION AND REASON

--

The committee in reaching its decision to suspend Miss Hercock for 4 days took into account her guilty plea, her record under this rule, and her comments about the incident.

However the committee agreed with Stipendiary Steward Oatham that this was a breach at the higher end of the scale and the suspension period should reflect that.

--

Miss Hercock was suspended from race riding from the completion of racing on Sunday 6 January 2008 until the completion of racing on Saturday 12 January 2008. Included in the suspension period was a premier day.

Mr J P Oatham, later in the afternoon approached the committee with a request from Miss Hercock to review the dates of her suspension.

--

The hearing was reconvened and Miss Hercock told the committee that on reflection she would like the period of suspension to begin after racing at Tauranga on 2 January 2008 where she had a number of confirmed rides. She explained she was a little confused with the 7 day deferment and in hindsight wished the suspension to begin earlier.

It was pointed out to Miss Hercock that included in the original period of suspension of 4 days there was a premier day and Stipendiary Steward Oatham asked that if the committee agreed to Miss Hercock’s request that should be reflected in an increase period of suspension. She again indicated her desire to ride at a number of venues over the next few weeks.

The committee agreed to Miss Hercock’s request but because there was no premier day in the suspension period increased the period of suspension to 5 days.

--

Miss Hercock was suspended from race riding from the completion of racing at Tauranga Wednesday 2 January 2008 until the completion of racing on Wednesday 9 January 2008.
