Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham, that C Lammas rider of CAT?S EYES committed a breach of that Rule in that he shifted inwards near the 1000 metres when not the required distance clear of DANA STAR ridden by L Rutherford, causing a check to that runner.

DECISION & REASON:
--Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham, that C Lammas rider of CAT?S EYES committed a breach of that Rule in that he shifted inwards near the 1000 metres when not the required distance clear of DANA STAR ridden by L Rutherford, causing a check to that runner. Mr Lammas admitted the charge and was represented by Mr J Gibbs.
----Mr Oatham read the Rule then asked Mr W Robinson to demonstrate the films. Mr Robinson showed Mr Lammas' mount move inwards when only an estimated ? of a length clear of DANA STAR and then clearly showed the checking of that horse.
----Mr Lammas said his mount was a first starter and racing a little greenly, but he had made a misjudgement in moving when not sufficiently clear.
----PENALTY:
--Mr Oatham gave Mr Lammas' record and asked that a suspension be imposed.
--Mr Lammas stated that he was riding at most North Island meetings.
--The Committee after taking into account the submissions by both parties considered that a suspension is appropriate and accordingly suspended Mr Lammas from riding from the conclusion of racing on 18 September to the conclusion of racing on 25 September 2004.
