Following race 6 an information was filed pursuant to Rule 876(1) when it was alleged by the informant, Mr P Moroney, trainer of the fourth horse MAGICALMYSTERYTOUR, that his horse was interfered with by the second horse,

Following race 6 an information was filed pursuant to Rule 876(1) when it was alleged by the informant, Mr P Moroney, trainer of the fourth horse MAGICALMYSTERYTOUR, that his horse was interfered with by the second horse, THE GRIM REAPER, inside the final 50 metres. The margin between third and fourth was a short head.
----All connections were informed of the protest.
----Present at the inquiry:
--MAGICALMYSTERYTOUR ? trainer Mr P Moroney, rider Mr C Ormsby
--THE GRIM REAPER ? trainer Mr R Cameron, part-owner Mr S McGrail and jockey Mr C Ormsby.
----Mr Moroney, the informant, said that he saw his rider, Mr T Harris, sit up in the last 3 or 4 strides and upon questioning the rider believed the second horse had run out and cost him finishing third. He said Mr Harris could not ride his horse out for the last 3 or 4 strides.
----Mr T Harris, rider of MAGICALMYSTERYTOUR, said that approximately 50 metres from the post he had to ease his mount which he believed had cost him running third.
----Mr R Cameron, trainer of THE GRIM REAPER, while admitting his horse did run out it was very close to the line and that Mr Harris had over-reacted.
----Mr McGrail, part-owner of THE GRIM REAPER, believed his horse had only moved out a minimal amount.
----Mr C Ormsby, rider of THE GRIM REAPER, said he moved out half to one horse width, but said it was much closer than 50 metres to the line. He also said the third horse was getting home better than the fourth horse.
----Mr J Oatham, Stipendiary Steward, when asked for his interpretation of the incident said that Mr Ormsby was clear at the commencement of the movement, but conceded he had moved out into the line of MAGICALMYSTERYTOUR in the last 3 or 4 strides. If the Committee had any doubt the status quo should remain.
----DECISION:
--The Committee carefully considered all evidence and reviewed the video films. While agreeing that there was outward movement from THE GRIM REAPER 3 or 4 strides from the post we do not believe this affected the chances of MAGICALMYSTERYTOUR finishing in a better place.
--Relevant in that decision was the short distance from the post when the interference occurred, and the strong manner in which the third horse was finishing.
----Accordingly the protest is dismissed and the Judge's placings shall stand. We order the filing fee to be refunded.
