Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr J Oatham, that Mr C Ormsby, rider of SENTURA allowed his mount to shift inwards near the 800 metre mark when not sufficiently clear

Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr J Oatham, that Mr C Ormsby, rider of SENTURA allowed his mount to shift inwards near the 800 metre mark when not sufficiently clear of MIXED EMOTIONS (C Anderson) who clipped a heel dislodging the rider.

Mr Ormsby pleaded guilty to the charge and was represented by Mr L A O?Sullivan.

Mr W Robinson, Assistant Stipendiary Steward, demonstrated the video films and showed where at the 800 metre mark Mr Ormsby who was approximately ? to a length clear of MIXED EMOTIONS move in taking that horse's line and cause rider C Anderson to clip heels, lose her balance and fall from the saddle.

Mr Robinson said Mr Ormsby had looked across before moving in, but he was insufficiently clear when doing so. He added that Mr Ormsby had not moved in a lot.

Mr C Ormsby said in evidence that he thought he was clear when he moved across. He said he had not moved a lot, but admitted it had resulted in a fall.

--

Mr L O?Sullivan said in representing Mr Ormsby that it was an error of judgement on Mr Ormsby's part and that he had not moved in a lot. He also said Claire Anderson called to Mr Ormsby telling him to go ahead.

Mr J Oatham, Stipendiary Steward, when asked for his interpretation said it was obviously a clear breach of the Rule as Mr Ormsby was only a bare length clear.

PENALTY:

--

Mr Oatham produced Mr Ormsby's record which showed five charges in the last 12 months, but only one in the last six months. He said the Committee should consider that a fall resulted from the interference and believed a suspension was appropriate.

Mr Ormsby said he is coming north whenever he can.

--

--

Mr O?Sullivan asked the Committee to take into account Mr Ormsby's guilty plea and that he is coming north on a regular basis.

The Committee considered all submissions and before imposing a penalty took into account the following:

  1. Mr Ormsby's guilty plea.

    --

  3. The degree of carelessness.
  4. --

    --

    --

  5. His record and improvement he has shown in the last six months.
  6. --

    --

  7. The consequence of the interference when a rider was dislodged.

Accordingly we impose a term of suspension to commence after racing on 18 August and conclude after racing on 25 August (4 days).
