As the committee is satified that Mr Collett rides throughout the country all race days have been taken into account. Accordingly after considering all the above facts we impose a suspension on Mr Collett from riding in races which is to start after racing on 18 September and conclude after racing on 7 October 2011(14 riding days).

Facts:
Following race 1 an information was filed pursuant to rule 638(1) (d). The informant Mr A Coles alleged that Mr J Collett permitted his mount TRALEE to shift inwards when not sufficiently clear of KARINA ROCK (Miss A Collett). This caused Miss Collett's mount to clip a heel and blunder approaching the 200 metres which resulted in her being dislodged.
Submissions for Decision:
Mr Williamson demonstrated the video films which showed TRALEE ridden by Mr J Collett racing in a 2 wide position upon entering the home straight. At this stage KARINA ROCK ridden by Miss A Collett was trailing TRALEE by approximately 2 lengths. KARINA ROCK then improved her position to within a length of TRALEE which was under pressure to maintain its position. Mr Williamson said KARINA ROCK had an established run against the rail. He stated that Mr Collett struck TRALEE with his whip in his right hand which caused his mount to shift in and into the line of KARINA ROCK when barely a length clear. This caused KARINA ROCK to blunder and dislodge its rider.
Mr Collett submitted he was leading on the rail but said his mount was under pressure causing it to drift outwards. He admitted his mount then moved back in when being ridden with the whip but said he was unaware of Miss Collett calling out.
Submissions for Penalty:
Mr Coles said Mr Collett had incurred 2 suspensions in the last 12 months which he said was a good record for the number of rides he has. However in this case because a fall had occurred he submitted it was a serious charge and believed an appropriate penalty was a 4 week suspension.
Mr Collett said he was a busy rider riding 3 to 4 times a week throughout the country. He said he had commitments until after racing on 18 September 2011.
Reasons for Penalty:
The committee carefully considered all evidence and submissions before imposing an appropriate penalty. Mitigating factors are Mr Collett's good record and his admission of the breach. However in this case the committee finds his carelessness in the mid to high range. Obviously he was insufficiently clear when moving in. Without the consequence of a fall this charge would normally attract a 6 day suspension. In assessing penalty on this occasion it is important to take in account that a fall has occurred through Mr Collett's carelessness.
