Rules:

Code:

Meet Title:
Taupo RC - 13 September 2020

Meet Chair:
NMcCutcheon

Race Date:
2020/09/13

Race Number:
R 6 and R 8

Decision:

As the charge was admitted it was deemed proved.

Penalty:

Mr Bosson was fined $500.

Addendum
The Chair recommended that in the short term, that Mr Bosson be weighed by a Stipendiary Steward on a Wednesday prior to Declaration time, and if he is somewhere near the required weight for the Saturday meeting, he can be declared for ride(s).
This practice would also apply to midweek meetings.

Facts:

Information No. A12938 was filed with the Judicial Committee. It was alleged by the Informant that Mr Bosson failed to make the contracted weight for HIGH ACHIEVER and ZINZAN.

Mr Bosson, who was on speaker-phone, said that he understood the Rule, the charge and confirmed that he admitted the breach.

Submissions for Penalty:

Mr Jones said that it was Mr Bosson’s second breach of the Rule within 120 days, with the previous being approximately one month ago when a fine of $500 was imposed.

The RIU suggested that a similar fine be imposed.

Mr Bosson said that he had been trying to meet the contracted riding weights, but that for various reasons had been unsuccessful in doing so.

Reasons for Penalty:

It is very obvious that Mr Bosson has extreme problems with his weight and as a consequence has failed to meet the contracted weights on approximately 12 times in the last 12 months. This is somewhat disturbing and has had a significant effect on connections, Clubs and the punters, who invest on Mr Bosson’s mounts prior to being aware of his being overweight, thus being replaced on raceday.
Taking into consideration all matters pertaining to penalty it was determined that a fine of $500 be imposed.
