Decision:

Following race 3 an information was filed pursuant to Rule 520(4)(c) by the informant Mr M Williamson.  He alleged that Mr Stackhouse failed to make the agreed weight for his mount MR ALFIE in race 3.

Mr Stackhouse pleaded guilty and was represented by his employer, Mr M Walker.

Mr Williamson said it was found prior to the race that Mr Stackhouse after being 1 kg over the claimable weight he failed to tell Mr Scott he could only claim 2 kgs instead of the 3 kgs as in the race book.

Mr Williamson produced Mr Stackhouse’s record which showed Mr Stackhouse had incurred 2 previous charges under this Rule in the last 6 weeks although there were mitigating factors surrounding the last charge.  He submitted a fine in the $150 - $250 range was appropriate.

Mr Stackhouse while admitting the charge said he was afraid of telling Mr Scott he could only claim 2 kgs instead of the 3 kgs as shown in the race book.

Mr Walker told the Committee there were mitigating factors in the charge on 19.7.08 and the Committee should consider this.

PENALTY:

--

The Committee considered all submissions and took into account Mr Stackhouse’s guilty plea and his record.  Before imposing penalty Mr Stackhouse was reminded of his obligations under this particular Rule.  Accordingly Mr Stackhouse was fined the sum of $200.
