Mr Innes admitted the charge.

Stipendiary Steward Mr A Coles demonstrated the video. He showed STELLA LIVIA progressing down the straight. Approximately 4-5 strides before the winning post Mr Innes could be seen to stop riding his horse and just before the line ONE NIGHT STAND passed him. ONE NIGHT STAND was placed 5th by the judge with a head back to STELLA LIVIA.

Mr Innes said that the trainer expected a good run from his mount. He had given it every opportunity however it was tiring badly at the finish and he felt that even if he had kept riding it out he would not have finished in a better position.

As Mr Innes pleaded guilty the committee has to adjudicate on the penalty only.

Mr Williamson said that Mr Innes had never been charged for a breach of the rules as listed in this charge. He asked for a fine in the vicinity of $300. He added that a stake of $200 was possibly lost.

Mr Innes repeated his claim that he did not think that he would have been better placed if he had continued to ride out his mount to the line.

Mr Williamson’s submissions are accepted and accordingly Mr Innes is fined $300.
