Facts:

Information No. A12925 was filed with the Judicial Committee. It was alleged that Mr Bosson failed to make the weight for Race 1 (BABY SHARK), Race 2 (MARKUS AURELIUS), Race 3 (LETHAL), Race 6 (KHAFEEF), Race 8 (SUPER SID).

Mr Bosson said that he understood the Rule and acknowledged that he admitted the breach.

Mr Jones said that it was over 120 days since Mr Bosson had breached the Rule and normally it would have been dealt with under a minor infringement. He said that as Mr Bosson could not make the weight for 5 horses, he believed an uplift in penalty was required due to Mr Bosson’s record and that five owners had been let down.

Mr Bosson said that he had not race ridden since April but had been working very hard with trackwork, trials and gym work every day in an effort to get his weight down.

Mr Bosson’s record was produced which showed the following recent penalties had been imposed for a breach of Rule 330(3)(c):

15.02.20-$600 Fine
---26.12.19-$500 Fine
---27.11.19-$100 Fine

Mr Jones said that Mr Bosson’s weight today was between 60-61kg.

Mr Jones submitted that the RIU was of the opinion that a Fine in the vicinity of $500 be considered as it needed to be sufficient to be a deterrent to Mr Bosson.

Mr Bosson said that he felt that that figure was a little high. He reiterated that he has been trying very hard to get his weight down, but that the last kilogram or so had proved difficult to shift.

Reasons for Penalty:

The Committee took into consideration all penalty submissions and whilst sympathetic to Mr Bosson’s plight of having to shed significant weight to meet raceday obligations, it was also mindful that owners and punters were adversely affected.
