The Committee was satisfied that VERONICA was a denied a fair start due to mechanical failure and therefore declared it a non starter.
Facts:
Following the running of Race 6 an information was filed pursuant to Rule 632 requesting a ruling as to whether Veronica (P Turner) was denied a fair start due to a starting gate malfunction.
Submissions for Decision:
Mr Coles demonstrated the incident by showing the head and side on video footage of the start. He believed they clearly showed that the barrier of Veronica was slow to open.
Mr Turner agreed with Mr Coles and had nothing further to add.
Starter Mr Moody confirmed the gate was slow in opening probably due to the wind strength and he had subsequently taken steps to prevent any recurrence.
Reasons for Decision:
The head on footage clearly showed Veronica's barrier gate was still closed when the other runners gates were open. She had to force open the gate and in doing so was denied a fair start due to a mechanical failure.
