This enquiry concerns a protest lodged following the running of race 6.     The protest was lodged by Mr C Ormsby alleging that DOENG ROSE, or its rider, placed second by the judge, interfered with the chances of CHARAAD, placed third by the judge.

DECISION & REASON:

This enquiry concerns a protest lodged following the running of race 6.

--

The protest was lodged by Mr C Ormsby alleging that DOENG ROSE, or its rider, placed second by the judge, interfered with the chances of CHARAAD, placed third by the judge. The interference is alleged to have occurred in the early part of the straight.

The margins were ? of a length between 2nd and 3rd.

--

Present at the hearing were Mr L O?Sullivan & Mr C Ormsby representing CHARAAD, and Mr S Rees & Miss C Tetzlaff representing DAENG ROSE.

--

In summary Mr Ormsby claimed that DAENG ROSE took his line as the field entered the straight and the resultant check cost him the race.

In response Miss Tetzlaff admitted that interference did take place.

--

Head and side on videos were also demonstrated.

--

We are satisfied that, with approximately 300 metres to run, CHARAAD suffered interference which was caused by DAENG ROSE.

We have reached our decision having regard to our impression of the witnesses and our observation of the films.

--

We prefer the view expressed by the rider and connections of CHARAAD and Stipendary Steward Mr C George that DAENG ROSE?S outward movement did cause CHARAAD to be checked

--

Having concluded that DAENG ROSE interfered with the chances of CHARAAD we have discretion to relegate DAENG ROSE behind CHARAAD. There must be a valid reason to exercise our discretion to relegate that outweighs any reason to let placings stand. After taking all relevant facts into consideration we are of the opinion that although CHARAAD did suffer a check he quickly regained his balance. The ? length margin at the finish does not, in our view, warrant a change in placings.

The protest is therefore dismissed.
