Accordingly, the protest is upheld and the amended placings are now:

1st No. 8 WANABEFAMOUS
2nd No. 7 ADDICTIVE HABIT
3rd No.1 THORN PRINCE
4th No. 3 PUMP UP THE VOLUME

In conclusion we order the payment of stakes and dividends.

Facts:

Following the running of Race 6, Woods Group Taumarunui Gold Cup, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr Oatham, alleged that ADDICTIVE HABIT placed 1st equal by the Judge interfered with the chances of WANABEFAMOUS placed 1st equal by the Judge.

The interference was alleged to have occurred over the final 150 metres.

The Judge's placing were as follows:

1st No. 7 ADDICTIVE HABIT
1st No. 8 WANABEFAMOUS
3rd No. 1 THORN PRINCE
4th No. 3 PUMP UP THE VOLUME

The official margin for 1st place was a dead heat.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

The Committee granted Mr Rogerson’s request to be present at the hearing as his apprentice Mr Hutchings was involved in the protest.

Mr Williamson using the available video identified ADDICTIVE HABIT which was racing 3 horse widths off the running rail. He said at the 150 metre mark WANABEFAMOUS was being urged forward when ADDICTIVE HABIT commenced to roll out 2 to 3 horse widths. At this point ADDICTIVE HABIT took the running line of WANABEFAMOUS who as a result became unbalanced and then finished the race off strongly. Mr Williamson said given the margin was a dead heat WANABEFAMOUS would have won the race outright had the interference not occurred.

Mr Hutchings submitted that WANABEFAMOUS came from a length behind ADDICTIVE HABIT who made contact with his mount causing it to lose balance. He said that just after the contact, Mr Cameron’s whip unintentionally struck his mount's head. Mr Hutchings said he then had to balance up WANABEFAMOUS and believed he made up 1 length in the run to the finish.

Mr Manning submitted that WANABEFAMOUS had to come from behind ADDICTIVE HABIT and the Committee should take into account there was no margin between the 2 horses at the finish. He added the interference cost his horse the win.

Mr Cameron submitted that his mount ADDICTIVE HABIT did shift out but noted that it had been hanging during the race. He accepted that ADDICTIVE HABIT made contact with WANABEFAMOUS but submitted it did not stop Mr Hutchings from riding his mount out to the finish. He told the Committee in moving out he put pressure on WANABEFAMOUS but that horse couldn’t get past him and he had his chance to win the race.

Mr Somervell submitted said he couldn't argue with the video films but pointed out to the Committee that when the two horses got so close together there was always going to be a clash, with Mr Cameron a right-handed whip rider and Mr Hutchings a left-handed whip rider.

In response to a question from the Committee, Mr Somervell acknowledged that ADDICTIVE HABIT did interfere with the chances of WANABEFAMOUS over the final 150 metres.

In summing up Mr Oatham submitted that at the 150 metre mark WANABEFAMOUS was racing free of interference and then ADDICTIVE HABIT shifted out. This caused crowding to WANABEFAMOUS whose rider Mr Hutchings put the whip away for 4 strides and was unable to ride his mount out. He said this was a direct result of ADDICTIVE HABIT shifting out 2 to 3 horse widths. He said had the interference not occurred WANABEFAMOUS would have beaten ADDICTIVE HABIT.

Mr Somervell advised the Committee that he had nothing further to add in summing up.

Reasons for Decision:

The Committee carefully considered all of the submissions and reviewed the video films several times. The films show that interference did occur over the final 150 metres with ADDICTIVE HABIT shifting out approximately 3 horse widths. It was very clear that ADDICTIVE HABIT took the rightful running line of WANABEFAMOUS causing that horse to lose momentum at a critical point in the race. A significant factor in reaching our decision is WANABEFAMOUS finished the stronger of the 2 affected horses over the concluding stages. The Committee is in no doubt given the dead heat margin that WANABEFAMOUS would have beaten ADDICTIVE HABIT had such interference not occurred.
