As Mr Bliss admitted the charge it was found to be proved.

Mr Bliss was fined $300.

Facts:

Prior to the commencement of the hearing, Mr Oatham informed the committee that Mr Bliss had admitted the charge and did not wish to be present at the hearing.

Rule 614(2) provides:
A person must not be neglectful or careless in saddling a horse.

Following the running of R4 (KEANO @ SENTRY HILL FARM 1215), Information No. A6959 was filed with the Judicial Committee. It was alleged that Mr Bliss, the Trainer of HOT SHOT LASS presented the horse to race without the lead-bag.

Mr Oatham explained how the error was detected prior to Race 4. This was during the Stipendiary Stewards routine checks of gear etc in the parade ring. The horse was then sent to be re-saddled with the lead-bag.

Submissions for Penalty:

Mr Oatham submitted that Mr Bliss had been training for approximately 20 years and had a clear record under this rule. He provided the committee with four recent examples of penalties for this breach which ranged from $300 to $400. He submitted that a penalty at the lower end would be appropriate.

Reasons for Penalty:

The committee referred to the JCA penalty guidelines which has a starting point of a $500 fine. It was fortunate that the error was detected with the horse being re-saddled and as a result no one was adversely affected; as HOT SHOT LASS went on to win the race.

The committee determined that a reduction on the starting point was warranted due to Mr Bliss’ record and the admittance of the breach.
