As the breach was admitted we find the charge proved.

Accordingly after taking all the above into account we impose a fine of $200.

Facts:

Following race 5 the informant Mr J Oatham alleged that Miss M Vance used the whip excessively on the horse ABBOTTABAD.

Submissions for Decision:

Mr Oatham demonstrated the video films which showed Miss Vance strike her mount approximately 15 times before the 200 metres.  Mr Oatham said this was well outside the whip guidelines and Miss Vance failed to give her mount the required  respite.

Miss Vance in admitting the breach said she had missed the start and from then on was under pressure to improve.  She confirmed that she did not receive specific riding instructions.

Submissions for Penalty:

Mr Oatham said Miss Vance was last charged under this rule 2 years ago which constituted an excellent record.  Mr Oatham said however in this case Miss Vance was clearly in breach of the rule.  He submitted a fine in the vicinity of $200 would be appropriate.

Miss Vance had nothing to say regarding penalty.

Reasons for Penalty:

The committee considered all the evidence and submissions as presented.  Mitigating factors are Miss Vance's admission of the breach and her good record under this rule.  However in this case by striking her mount 15 times without respite she was clearly in breach of the whip guidelines.  Miss Vance was reminded of her obligations in particular the hitting of her mount when it is not responding.
