This is a protest lodged by trainer John Sargent (SERVE TO LEAD) alleging interference by SEEKING THE DREAM (R Norvall) number 9 placed first by the Judge, affecting the chances of SERVE TO LEAD (G McKeon) number 10, placed fourth by the Judge, in respect of Taumarunui & Districts RSA 1200 on 29.7.06 at Te Rapa.

The margins ? half a length, ? length and half a head.

The protest was lodged pursuant to Rule 876(1) and seeks relegation of SERVE TO LEAD. It was lodged in accordance with Rule 1107(2).

The first question which we are required to consider is whether SERVE TO LEAD was interfered with and whether SEEKING THE DREAM caused that interference as alleged.

--

The Committee heard evidence from Mr J Sargent, trainer of SERVE TO LEAD, and jockey Gavin McKeon, rider of SERVE TO LEAD. Mr Sargent said focus on the last 10 metres of the race. Mr McKeon said he suffered interference, line dictated in the last four strides prior to the finishing line. He said he sat up on his mount. He emphasized the half head margin between third and fourth placings.

Mr Gately disputed whether his horse actually caused interference as alleged. He pointed out on the video that SERVE TO LEAD had moved inwards.

We have carefully considered and reviewed the video tapes (head on and side on). We find minor interference happened very close to the finishing line. Accordingly we are not satisfied that the chances of SERVE TO LEAD were affected by the alleged interference.

It is therefore our considered opinion that SEEKING THE DREAM should not be relegated.

--

--

The protest is dismissed and the placings stand as they crossed the line ? 9, 1, 12, 10, 7, 13.

In the circumstances we order that the sum of $100 be refunded.
