Hearing Type (Code):
thoroughbred-racing
Decision: --
After Race 10, Trainer Mr GA Rogerson (AVE MAREE) lodged a protest against SANDGATE, No.3, and CONGALINE, No.5. The protest is a double protest.
--
DECISION AND REASON:
--After Race 10, Trainer Mr GA Rogerson (AVE MAREE) lodged a protest against SANDGATE, No.3, and CONGALINE, No.5. The protest is a double protest.
--The double protest was heard together.
--Mr Rogerson alleges that CONGALINE (M Walker) placed first, and SANDGATE (L Allpress) placed second, interfered with the chances of AVE MAREE (O Bosson) placed fifth by the judge.
--It is alleged that interference occurred in the home straight.
--Both protests were heard together, the relevant protest rule being Rule 876(2)(b). Placings No.5, No.3, No.8, No.10, No.6. Margins Head, 1-1/2 lengths, Long Head, Long Head, Long Head.
--Mr Rogerson represented the connections of AVE MAREE, No.6, placed fifth.
--Mrs Lisa Allpress, jockey of SANDGATE, represented the connections of SANDGATE, No.3, placed second.
--Mr Walker represented the connections of CONGALINE, No.5, placed first.
--The protest was lodged pursuant to Rule 876(1) & (2)(b) and seeks joint relegation of SANDGATE and CONGALINE.
--The protest was not lodged by the Stipendiary Steward, therefore the sum of $100 has been lodged with the Registrar in accordance with Rule 1103(4)(ii).
--All connections were notified of the hearing and place of hearing.
--The Judicial Committee heard evidence from Mr Rogerson, trainer of AVE MAREE, No.6. He demonstrated on the race videos (side-on and head-on) the alleged interference by SANDGATE. He asserted that SANDGATE, ridden by Lisa Allpress, moved inwards and dictated the rightful running line of his horse AVE MAREE. He emphasised the margins (long head, long head). Mr Bosson confirmed Mr Rogerson's statement.
--Mrs Allpress demonstrated on the race videos, there was minimal movement and her mount maintained a straight line. She did not accept that her mount caused interference to AVE MAREE.
--Mr Oatham proffered a statement. He confirmed Mrs Allpress's evidence and observations.
--The Committee carefully reviewed the parties respective statements and the race videos (head-on and side-on) and were not satisfied that interference occurred (AVE MAREE and SANDGATE).
--Accordingly, given the findings at this point of the protest there is no need to consider the protest against CONGALINE. Rule 876(2)(b).
--The protest was dismissed (Information No.30747), and the Committee ordered the refund of the deposit to Mr Rogerson.
