As the breach was admitted we find the charge proved.

Penalty:

After taking all the above into account we impose a suspension on Mr Castano which will start after racing on 29 July and conclude after racing on 13 August 2012 (6 days).

Careless Riding Charge

Facts:

Following race 3 an information was filed pursuant to rule 638(1) (d).  The informant Mr J Oatham alleged that Mr J Castano permitted his mount SWEET N KEEN to shift inwards near the 150 metres striking a heel of TANGOETTE (S Spratt) and blundering.

Submissions for Decision:

Mr Robinson demonstrated the video films which showed SWEET N KEEN racing on the outside of TANGOETTE in the run up the straight to the finish.  Mr Robinson pointed out to the committee where Mr Castano pulled the stick which caused his mount to shift inwards.  He said Mr Castano was not looking where he was going and kept riding forward when moving in.  This resulted in him clipping a heel and falling.

Mr Castano had nothing to say.

Mr Peard, representing Mr Castano, conceded that Mr Castano had rolled in and did not appear to have full control of his mount.  He said Mr Castano was riding a bit loosely but had only moved in approximately 1 1/2 lengths.  Mr Peard said he thought Mr Castano was unlucky to clip a heel.

Submissions for Penalty:

Mr Oatham said it was unusual to charge a rider following an incident such has this.  He said Mr Castano was clearly riding forward when shifting in which placed horse and rider at risk.  He added it was fortunate that TANGOETTE did not receive an injury resulting from being galloped on.  Mr Oatham submitted this was Mr Castano's 3rd breach in 33 rides and believed the breach was in the mid to high range.

Mr Peard told the committee that Mr Castano only rode in the Northern, Auckland and Waikato regions and had commitments until after racing on 29 July.  He accepted this breach was serious enough to be in the mid to high range but asked the committee to consider Mr Castano's inexperience.

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  In Mr Castano's favour are his admission of the breach and his inexperience.  However the committee is mindful that Mr Castano has incurred 2 previous charges under this rule in his short career.  He made the mistake of continuing to ride forward when shifting in.  The committee finds this breach to be in the mid range.
