Facts:
Following the running of Race 8, Otorohanga Club Inc Premier, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr Oatham, alleged that WATTLE BAY placed 1st by the Judge interfered with SHARAKTI placed 2nd by the Judge.
The interference was alleged to have occurred in the final straight.
The Judge's placing were as follows:
1st No. 2 WATTLE BAY
2nd No. 12 SHARAKTI
3rd No. 12 YANGMING
4th No. 3 ARIZONA JAZZ
The official margin between 1st and 2nd was a nose.
Rule 642(1) provides: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
Prior to the commencement of the hearing all parties present acknowledged they had no objection to Trackside filming the protest or the Journalists being in the room.
Submissions for Decision:
Mr Robinson demonstrated on the head on film that WATTLE BAY did shift out for a period of 150 metres which resulted in SHARAKTI having its rightful running line dictated. He said that on 2 occasions WATTLE BAY did make contact with SHARAKTI. He stated Mr Sweeney erred in allowing his mount to continue to shift out at least 5 horse widths. He believed taking into account the nose margin at the finish the interference that occurred cost SHARAKTI winning the race.
Mr Forsman told the Committee that it was clear on the video films WATTLE BAY did push SHARAKTI over extra ground which resulted in her losing momentum. He said at no stage did Mr Sweeney stop riding WATTLE BAY forward which he believed certainly cost SHARAKTI winning the race.
Mr McDonald submitted that the interference he received from WATTLE BAY was gradual and lasted for quite a while. He said this resulted in SHARAKTI being bumped on 2 occasions which put his mount off balance. He said the interference took its toll on SHARAKTI and had no doubt had the interference not occurred his mount would have won the race.
Mr Sanders advised the Committee that he had nothing to say in response to the submissions of Mr Robinson and the connections of SHARAKTI.
In response the Committee asked Mr Sanders if the protest was uncontested and he responded in the affirmative.
Mr Sweeney told the Committee that after viewing the head on film he “put his hands up” and also confirmed he did not contest the protest. Therefore, the Committee did not seek Mr Oatham's submissions.
Reasons for Decision:
The Committee carefully considered the submissions of the Informant, the connections of SHARAKTI and the fact that the protest was not contested.
The Committee’s own assessment of the alleged interference is that WATTLE BAY did dictate SHARAKTI at least 5 horse widths wider on the track for approximately 150 metres. The films clearly show that Mr Sweeney did not stop riding WATTLE BAY forward with the whip. This resulted in SHARAKTI being bumped on 2 occasions costing her valuable momentum. The final significant point is the official margin of a nose between 1st and 2nd place.
For these reasons we are satisfied that SHARAKTI would have beaten WATTLE BAY had interference not occurred.
