Decision:

As Mr Kareem admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Mr Kareem’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Kareem had his license to ride in races suspended for a period to commence after racing on 3 August and conclude after racing on 23 August 2019.

Facts:

Following the running of race 5, Bob & Colleen Donaldson Memorial 1215, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Kareem allowed his mount SPOTLIGHT DREAM to shift in when not sufficiently clear of FORTUNE PATCH which was forced inwards crowding SAIGNON, IRISH FLAME, and SMOKIN’ OAK from near the 1100 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Kareem said that he understood the Rule and confirmed he admitted the breach.

Mr Harris assisted Mr Kareem at the hearing.

Mr Jones demonstrated the incident using the available video footage. He identified that shortly after the start Mr Kareem (barrier 10) angled his mount inwards towards the running rail. He demonstrated that Mr Kareem continued to allow his mount to shift in when he had 6 horses on his inside. In doing so SPOTLIGHT DREAM was only ½ a length clear of FORTUNE PATCH which was forced inwards. As a result SAIGNON, IRISH FLAME, and SMOKIN’ OAK were all crowded to varying degrees losing ground. He described the level of carelessness as fairly high.

Mr Kareem said that he initially thought Mr Yanagida, the rider of FORTUNE PATCH, caused the interference to runners on his inside. However, after viewing the video footage he accepted that he rode in a careless manner.

Mr Harris said to Mr Kareem’s credit he admitted that he rode in a careless manner.

Submissions for Penalty:

Mr Williamson said that Mr Kareem had 1 previous charge under this Rule from 62 race day rides. He said that Mr Kareem shifted in quite some margin and this placed other riders in a difficult position. He said it was fortunate that Ms Thornton was an experienced rider and she eased SAIGNON and relinquished her position. He described the level of carelessness as high and noted that Mr Kareem was an inexperienced Apprentice rider. In conclusion Mr Williamson submitted a suspension of not less than 7 days would be appropriate.

Mr Kareem was unsure of his commitments in the next 7 days therefore the Committee granted an adjournment to the hearing so he could speak to his employer Mr Lock.

Mr Kareem advised the Committee that he had engagements at Te Rapa on 3 August and he requested a 7 day deferment to his proposed suspension.

In response to a question from the Committee, Mr Kareem acknowledged that the level of carelessness was high.

Mr Harris submitted that Mr Williamson had summed up the incident well. In addition he accepted that the level of carelessness was high.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

When reviewing the video footage the Committee found that approximately 100 metres after the start Mr Kareem allowed his mount to shift in when not the required distance clear of 4 runners to his inside. We observed that Mr Kareem looked to his inside on 2 occasions when shifting ground. Nevertheless, he continued to shift inwards for some distance when insufficiently clear to do so. Mr Kareem made no discernible effort to avoid causing interference to 4 horses on his inside. It was evident on the footage that SPOTLIGHT DREAM was only ½ a length clear of FORTUNE PATCH which was forced inwards. In turn that runner was no more than ½ a length clear of SAIGNON, IRISH FLAME, and SMOKIN’ OAK which were all racing within a neck of each other. As a consequence all of their respective riders’ had to take a firm hold of their mounts when badly tightened for room. This resulted in all runners losing ground. In total we estimated that Mr Kareem allowed his mount to shift in 6 horse widths. The Committee deemed the level of carelessness displayed by Mr Kareem was in the high range.

The JCA Penalty Guide starting point for high range carelessness is 10 national riding days which we adopted.

The mitigating factors were Mr Kareem’s admission of the breach and his inexperience as an Apprentice rider. For these collective factors he was afforded a 1 day reduction in penalty.

We deemed Mr Kareem’s record to be a neutral factor.

After taking into account all the above factors the Committee considered that an appropriate suspension was 9 national riding days.
