Decision:

As Ms Chiong admitted the breach we find the charge proved.

Penalty:

We grant Ms Chiong's request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, we impose a suspension on Ms Chiong which will commence after racing on 1 August and conclude after racing on 9 August 2013 (5 days).

The penalty did not include Christchurch on August 7 as Ms Chiong has no history of riding there.

Charge:

Following race 4, United Gaming Ltd Premier, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that Ms Chiong permitted her mount DANROSE to shift inwards near the 850 metres when not sufficiently clear of AIRFIELD ROAD which was checked.

Ms Chiong acknowledged that she understood the nature of the charge and the Rule and was assisted by her employer Mr Richardson.

Rule 638(1) (d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Facts:

Mr Coles demonstrated on the head on film that Ms Chiong's mount DANROSE was racing 5 off the rail approaching the 900 metres with AIRFIELD ROAD racing 3 off the rail. He said shortly after this point Ms Chiong allowed her mount to shift inwards when a bare length clear of AIRFIELD ROAD which was checked sharply.

Mr Richardson, who spoke on behalf of Ms Chiong, conceded she was not the required distance clear when shifting in. He believed the interference was minimal and noted if Ms Chiong had waited for 1 or 2 strides she would have been clear of AIRFIELD ROAD.

Submissions for Penalty:

Mr Oatham produced Ms Chiong's record which showed 3 previous breaches under this Rule in the last 12 months. He said Ms Chiong has ridden in 67 tote races and stated she is inexperienced. He said Ms Chiong made an error in allowing her mount to roll in a stride or 2 early which resulted in AIRFIELD ROAD being checked. He stated the level of carelessness is at the low end and in mitigation AIRFIELD ROAD did not react kindly when checked. He submitted a suspension would be an appropriate penalty.

Mr Richardson submitted the breach is at the low end and for a matter of 2 strides Ms Chiong would have been clear of AIRFIELD ROAD. He submitted a suspension at the low end would be appropriate.

Mr Richardson advised the Committee that Ms Chiong has commitments at Waverley on August 1, and that any period of suspension could commence after that.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Ms Chiong's admission of the breach and we assess the level of carelessness as low range. However, this has to be balanced against Ms Chiong record under this Rule. We believe Ms Chiong is fashioning a poor record with today being her 4th careless riding charge from 67 rides.

After taking into account all the above factors we consider an appropriate penalty is a 5 day suspension.
