As the breach was admitted it was deemed to be proved by the Committee.

Penalty:

Mr Pinn’s Apprentice Jockey’s Licence was suspended from the end of racing on 1 January up to the cessation of racing on 13 January 2019.

Facts:

Following the running of Race 4 (Farmlands “OAKLANE CHAFF” 1600), Information No A8846 was filed with the Judicial Committee. It was alleged by the Informant that Mr W Pinn the rider of SPONDULIX angled his mount out near the 200m when not clear of ST ANDRE which was checked.

Rule 638(1)(d) provides:
A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless

Mr Pinn said that he understood the Rule and confirmed that he admitted the breach.

Mr Goodwin showed the film replays and said that Mr Pinn did not have a clear run ahead and angled out sharply for a run. He said that Mr Elliot had to check his mount ST ANDRE which was forced over extra ground. Mr Goodwin said that it was clearly a lack of patience.

Mr Pinn said that he had a horse in front of him and had nowhere to go. He said that when he did come out his horse overreacted.

Mr Sharrock said that it was a lack of patience and the only thing in Mr Pinn’s favour was that ST ANDRE was never going to win.

Submissions for Penalty:

Mr Balcombe said that the record showed that Mr Pinn had had 3 careless riding breaches within the last 12 months, with the most recent being on 8 December 2018 when an 8 riding-day suspension was imposed. Mr Balcombe said that this was Mr Pinn’s first day back riding from his most recent suspension. He placed the carelessness in the mid-range area and submitted that a term of suspension would be appropriate.

Mr Pinn said that the record was correct and that he agreed that the carelessness was mid-range. He asked for any suspension imposed to start after racing on 1 January 2019.

Mr Sharrock did not have anything to add.

Reasons for Penalty:

The film evidence was very clear in showing Mr Pinn angling out for a run when not clear of ST ANDRE. As a consequence of Mr Pinn’s action ST ANDRE was forced out a number of horse widths with the rider, Mr Elliot having to check and steady his mount.

Taking into account the admission of the breach, Mr Pinn’s record, the degree of carelessness (mid-range) and the JCA Penalty Guidelines the Committee determined that a 9 riding-day suspension was a suitable end result.
